WASHINGTON, D.C. — U.S. Senator Jim Banks of Indiana introduced legislation on Monday aimed at limiting birthright citizenship. The bill seeks to amend federal law to deny automatic citizenship to children born in the United States to parents who are in the country illegally.

The legislation would classify the children of undocumented immigrants as children of “invaders,” invoking what Banks described as “a longstanding common law exception for children of foreign invaders.” It also aims to codify former President Donald Trump’s declaration that the U.S. is under an “invasion” by illegal migrants. Banks said in an interview published Monday that “The Supreme Court's birthright citizenship decision was an unprecedented assault on American sovereignty, and we must do whatever it takes to save our country.”

He added, “The legislation aims to ensure the millions of illegal aliens that invaded our country can't continue to exploit our immigration system.” The bill follows a June 2026 Supreme Court ruling that struck down Trump’s executive order on birthright citizenship as unconstitutional. That order, signed in January 2025, had sought to deny automatic citizenship to children of parents unlawfully present or in the U.S. temporarily.

Since the start of his second term, Trump has pursued an immigration agenda that includes tightening border controls, expanding deportations, and seeking stricter voter registration requirements. He has accused Democrats of using immigration to “expand their voter base [and] cheat in elections.” Legal challenges to several of the administration's immigration measures remain ongoing.
