DELHI — An eight-month-old infant identified as Pia was raped in her home in northwest Delhi on January 28, 2018. Her mother, Rakhi, found Pia injured upon returning home and subsequently filed a police report, leading to a criminal investigation.

Rakhi and Pia's father, Madhav, had left their two children, Pia and her older sister Muskan, in the care of Madhav's extended family on the day of the incident. The family resides in an eight-by-eight-foot room within a shared home that includes Madhav's two older brothers, their wives, and their children. Suraj, identified as the son of Madhav's eldest brother, lived in a room on the floor above Pia's family and was 28 years old at the time.

Upon her return, Rakhi found Pia in a pool of blood and excrement. Muskan was on the terrace at that time. Rakhi stated that she asked Suraj if he had entered her room. Rakhi then took her daughters to the home of a woman for whom she worked. A doctor at a neighborhood clinic examined Pia and advised Rakhi to contact the police.

Rakhi proceeded to the Netaji Subhash Place police station. Additional Sub Inspector supervised the process of filing a First Information Report (FIR). The FIR was filed under Section 6 of the Protection of Children from Sexual Offences Act of 2012, along with other relevant sections of the Indian Penal Code. The officer later became the Investigating Officer for the case.

Pia was admitted to Kalavati Saran Children's Hospital for inspection and treatment. Suraj later told police that he committed the act under the influence of liquor. Rakhi described her immediate realization of the event, stating, "It felt like everyone else knew before I could articulate the words – before I could even say the words aloud to someone – that my baby had been raped."
