US — President Joe Biden commuted the sentences of 37 men on federal death row before leaving office. He did not commute the sentences of Dylann Roof, Dzhokhar Tsarnaev, and Robert Bowers.

The Marshall Project analyzed more than 9,000 death sentences handed down in the US since 1976. The analysis found that less than one out of every five people sent to death row has been executed, and more than one-third of death sentences in the last 50 years have been overturned by courts. Frank Baumgartner, a University of North Carolina at Chapel Hill professor, said, "Our system is an epic fail." He added, "Every flaw they sought to rectify has been a failure, and now there are new problems that didn't used to exist."

Capital trials in the US regularly cost at least one million dollars. Black people are overrepresented on state death rows. One out of 50 death row cases since 1972 resulted in release due to evidence of innocence. Over 400 death sentences in the U.S. have been commuted by a governor or president. As of now, 23 US states have abolished the death penalty.

There are more than 2,000 people on death rows across the US. More than one-quarter of people on US death rows have been there for more than 30 years. The average person executed in the US last year waited on death row for almost 27 years, an increase from the average wait time of 12 years three decades ago. Eight percent of death sentences over the last 50 years resulted in the condemned person dying from causes other than execution. Support for the death penalty in US polls has declined to approximately 50%.
