MISSOURI — A federal judge dismissed a lawsuit against OpenAI CEO Sam Altman brought by his sister, Annie Altman, accusing him of sexual abuse. The judge ruled that Annie Altman's allegations were filed too late under the statute of limitations.

The judge allowed Annie Altman to refile her lawsuit under Missouri's Childhood Sexual Abuse law, which offers an extended statute of limitations. The judge gave Annie Altman until April 3 to file a new lawsuit.

The judge granted Sam Altman's defamation countersuit accusing Annie Altman of defamation and of abusing the legal process. Sam Altman's countersuit states that Annie Altman made up the allegations of sexual abuse, posted them on social media, and included them in her lawsuit after their family declined her demands for unrestricted financial support.

Annie Altman filed her lawsuit in a federal court in Missouri in January 2025. Annie Altman alleged that Sam Altman sexually abused her between 1997 and 2006, beginning when she was three years old, while they were growing up in Clayton, Missouri.

Sam Altman has denied the allegations. In a public statement following the filing of the lawsuit, Sam Altman, his two younger brothers, and their mother said that Annie Altman had mental health issues. Sam Altman is nine years older than his sister, Annie Altman.

"The Court granted leave for Ms. Altman to file an amended complaint, which we will do promptly," said Ryan Mahoney, an attorney.
