PALM BEACH COUNTY — Kathleen Thomas was issued a $116 citation by a Palm Beach County Sheriff’s Office deputy in February for allegedly holding a cellphone while driving. The deputy told Thomas he saw her driving while holding a phone with her right hand and manipulating it.

Thomas does not have a right hand. When the deputy made the accusation, she responded, "Obviously not. Ha ha ha," while lifting her right arm to show the absence of a hand.

The deputy asked Thomas to put a "hand to God" that she was not holding her phone while driving. "Hand to God," Thomas replied, holding up her right arm.

Thomas was still issued a citation for allegedly holding a wireless communication device while driving. She asked the deputy whether the citation specified the phone was in her right hand, and he confirmed it did not, though he maintained his original accusation was that she held the phone in her right hand.

Thomas requested an in-person court hearing to challenge the citation. The case was dismissed due to "lack of evidence," according to court documents.
