TEXAS — US District Judge Fred Biery of the Western District of Texas on Thursday ordered the release of Hayam El Gamal and her five children from the Dilley immigration detention center in a remote area of Texas south-west of San Antonio. The family was released hours after the order, ending a detention of more than ten months that was the longest family detention under Donald Trump's second administration.

El Gamal and her five children, ages five to eighteen, were taken into federal custody last June after a firebomb attack in Boulder, Colorado. Mohamed Sabry Soliman, El Gamal's ex-husband, was charged over the attack, in which an eighty-two-year-old woman who was injured later died. El Gamal divorced Soliman after his arrest.

Under the terms of the release, El Gamal and her eldest daughter, Habiba Soliman, eighteen, will have to wear ankle monitors. A federal court blocked the Trump administration from deporting the family following their release.

The family's legal team said they had no advance knowledge of the suspect's plans and that the family was detained unlawfully. An FBI agent testified under oath that there was no evidence the family was aware of the father's plan. The government said federal agents were investigating the extent to which the family knew about the attack.

The legal team said the family's health deteriorated during detention and alleged they were denied appropriate medical care, and that all five children were suffering from depression. El Gamal was taken this month to an off-site emergency room after experiencing severe pain, and a CT scan showed she had fluid around her heart, the family's lawyer said. She had also been hospitalized earlier in April due to a medical emergency related to an untreated growth on her chest, according to her lawyers.

The Department of Homeland Security criticized the ruling, calling Biery an "activist judge" who was releasing the family onto American streets. DHS said the family received medical care and due process.

Days after returning to their home in Colorado, immigration authorities detained the family on Saturday and sought to deport them. Biery granted an emergency order the same day barring the family's removal.

"The Trump administration has kidnapped the El Gamal family in violation of a federal court order from the Western District of Texas, which ordered them Thursday not to detain or remove the family from the United States," said Eric Lee, a lawyer for the family.
