WASHINGTON, D.C. — The Federal Aviation Administration issued a supplemental notice of proposed rulemaking on November 3, 2026, to update and clarify Passenger Facility Charge regulations. The proposal, identified by docket number FAA-2022-1315, aligns these regulations with the FAA Reauthorization Act of 2024.

The rule affects approximately 138 small-, medium-, and large-hub airports. The proposal shortens the review period for certain airports from 120 days to 60 days under the streamlined application process. It also extends the acknowledgement and objection period for Notice of Intent submissions from 30 days to 60 days.

An airport must be designated as a medium- or large-hub for three consecutive years before a turnback applies to a small-hub transitioning to those categories. Under the 2024 law, which was signed on May 16, 2024, turnback reductions for medium- and large-hub airports collecting $3 or less decreased from 50 percent to 40 percent. For airports collecting greater than $3, the turnback reductions decreased from 75 percent to 60 percent.

Comments on the proposed rule must be submitted within 60 days of its publication in the Federal Register. This action follows an earlier notice of proposed rulemaking regarding Passenger Facility Charge regulations that the agency published on September 27, 2023.
