The Department of Homeland Security issued an interim final rule on Tuesday reducing the response period for refugees facing status termination from thirty days to ten days. The rule, titled "Removing 30-Day Refugee Termination Notice," amends 8 CFR Part 207 to expedite the termination of refugee status when the Department determines an individual was not a refugee under section 101(a)(42) of the Immigration and Nationality Act at the time of admission.
The Department stated the changes aim to restore integrity to the immigration system, mitigate risks to national security and public safety, and prevent fraud and exploitation. The Department argued that allowing a longer notice period could provide opportunities for aliens to evade enforcement or engage in harmful activities. Written comments on the rule must be submitted via the Federal eRulemaking Portal within 30 days of the rule's publication in the Federal Register.
