WASHINGTON, D.C. — President Donald Trump nominated Dr. Heidi Overton to lead the Food and Drug Administration. Dr. Overton is scheduled to appear before the Senate Health, Education, Labor and Pensions Committee for her confirmation hearing on Thursday, Sept. 25, 2026, at 10:30 a.m.

The nomination triggers immediate scrutiny over Dr. Overton’s views on vaccines and abortion as she faces a Senate confirmation process. To become commissioner, Dr. Overton will need a majority of votes from the 21-member Senate Health, Education, Labor and Pensions Committee, followed by a positive vote from the full Senate. Sen. Bill Cassidy is the chairman of the Senate Health, Education, Labor and Pensions Committee.

Dr. Overton currently serves as deputy director of the White House Domestic Policy Council. She is a preventive medicine physician who previously served as chief policy officer at the America First Policy Institute. Dr. Overton served as a White House fellow during President Trump’s first term. She earned a medical degree from the University of New Mexico and a doctoral degree in clinical research from Johns Hopkins University, where she studied under Dr. Marty Makary.

If confirmed, Dr. Overton would be the youngest FDA commissioner in history at 37 years old. Her financial disclosure forms reported no investments in health care or food companies, though they listed $50,000 to $100,000 in student loans.

White House spokesman Kush Desai defended the nomination by citing Dr. Overton’s prior government service. "As an MD/PhD who helped President Trump deliver on Operation Warp Speed during his first term, Dr. Heidi Overton will ensure that policymaking is guided solely by Gold Standard Science at the FDA," Desai said.

Sen. Cassidy expressed concern regarding Dr. Overton’s stance on immunization protocols. On a television interview, Cassidy said that Dr. Overton must acknowledge that President Trump’s claim that the measles vaccine is lethal is 'absurd.' Kennedy Jr.’s 'Make America Healthy Again' movement and worked on White House health initiatives including the revamped food pyramid and efforts to overhaul childhood vaccines.

Dorit Reiss, a professor of law and vaccine policy expert at the University of California Law San Francisco, questioned the nominee's technical background. "I think she made it clear she’s a supporter of Kennedy’s vaccine agenda, at least," Reiss said. She added that Dr. Overton doesn’t appear to have expertise in clinical trials, managing an agency or any of the products the FDA regulates.

Dr. Overton’s past writings on abortion have also drawn attention. In 2024, she co-authored an article about then-Vice Presidential candidate Tim Walz titled 'Tim Walz Made Minnesota A ‘Sanctuary’ For Baby Killers And Child Mutilators.' While at the America First Policy Institute, Dr. Overton called for strict restrictions on medication abortion and praised the Supreme Court’s decision overturning Roe v. Wade. She claimed that medication abortion is 'dangerous to women' and referred to the mail delivery of mifepristone as 'chemical abortion on demand.'

Art Caplan, head of the medical ethics division at NYU Grossman School of Medicine, noted the political alignment on this issue. Caplan said Dr. Overton’s views on abortion appear to align with Sen. Cassidy’s. Sen. Cassidy has been pushing the administration to reverse a Biden-era rule that allows mifepristone to be prescribed via telemedicine and sent through the mail.

Last month, Cassidy accused the makers of mifepristone of failing to meet their legal responsibilities to ensure compliance with FDA safety regulations in a committee report. In January, Cassidy called on Health Secretary Robert F. Kennedy Jr. and former FDA commissioner Dr. Makary to complete a safety review of mifepristone at a hearing.

The FDA first approved mifepristone in 2000. Health Secretary Robert F. Kennedy Jr. ordered a reevaluation of mifepristone’s safety last year, and the agency launched a new safety study on the drug in June. Sen. Susan Collins and Sen. Lisa Murkowski are moderate Republicans on the Senate Health, Education, Labor and Pensions Committee who have supported federal access to abortion.

Dr. Overton inherits an agency undergoing personnel changes. The FDA lost about 3,500 employees in April 2025 layoffs. Since President Trump took office, the FDA has lost about 20% of its employees to layoffs, buyouts, retirements or resignations.

Kyle Diamantas is the current acting FDA commissioner following the departure of Dr. Makary, who resigned as FDA commissioner in May. Makary resigned in part over the administration’s decision to authorize several fruit-flavored vapes for adults.

Dr. Stephen Ostroff, a former acting FDA commissioner, discussed the operational challenges ahead. Ostroff said food safety will be another major issue waiting for Dr. Overton at the FDA. "After the experience of the past 18 months, it’s very important to restore public and industry confidence that decisions being made by FDA, including those by leadership, are science-based, transparent and consistent," Ostroff said. The FDA oversees U.S. medical products plus billions of dollars in food, cosmetics, tobacco and vaping products, employing approximately 16,000 staffers spread across numerous U.S. and international locations.
