MIAMI — Andrew Tate and Tristan Tate were arrested in Miami, Florida on July 18. The United Kingdom has requested the extradition of the brothers. They are being held in federal custody in Miami.

U.S. Magistrate Judge Lauren Louis is presiding over the extradition proceedings. A detention hearing was scheduled for August 13.

The defense motion argued that the brothers' high public profile makes it nearly impossible for them to flee undetected. The motion stated that the brothers regularly post updates about their locations on social media. The defense argued that the brothers proved they are not a flight risk by complying with all pretrial restrictions in Romania. The motion stated that every prediction the government made about the brothers fleeing has been answered by three years of data showing they do not flee.

The defense motion acknowledged there is a presumption against bond in extradition proceedings but argued release can be granted in special circumstances. The motion argued that holding the brothers under current conditions violates due process. The motion stated that the brothers have limited contact with their families, no television, no radio, and no commissary access.

The motion stated that the brothers sleep without pillows on bunks shorter than they are tall. The motion stated that the brothers are being held in a special unit for their own protection.

Prosecutors argued that the Tate brothers are a flight risk and a danger to the community. The U.S. Attorney’s Office filing stated that the brothers claim to maintain multiple passports and identities. The filing stated that the brothers have access to excessive wealth and influence in numerous countries.

The filing stated that the brothers are stridently unwilling to voluntarily return to face prosecution in the United Kingdom. The filing stated that allegations in Romania indicate the Tates attempted to intimidate witnesses.

Andrew Tate and Tristan Tate face charges in the United Kingdom including rape, sexual assault, facilitating trafficking for sexual exploitation, and offenses relating to indecent images of a child and extreme pornography. Britain's Crown Prosecution Service said on July 19 it brought new charges against the brothers. British prosecutors stated that new charges relate to four alleged victims and cover alleged offenses between July 2010 and August 2017.

Jared Holt is a senior researcher at Open Measures. "The Tate brothers have friends on Capitol Hill," Holt said. "There's people in the Trump administration that have cozied up to them before, people in the MAGA movement that have cozied up to them before, certainly," he added.

Kayla Gogarty is a research director at Media Matters. "It seems like the [Trump] administration is trying to distance themselves a little bit now," Gogarty said. "But in general, we see some of the MAGA media kind of split" on the Tates, she said.
