CHELTENHAM — Gloucestershire Hospitals NHS Foundation Trust pleaded guilty to a criminal offence for failing to provide safe care, an action that led to the death of patient Chris Elliot in August 2022. A district judge imposed a £300,000 fine on the healthcare trust.
Chris Elliot, aged 59, died on 23 August 2022, after being admitted to Cheltenham General Hospital for leukaemia treatment. The Care Quality Commission initiated the prosecution against the trust.
Pseudomonas aeruginosa bacteria was detected on a shower head in the Rendcomb ward on 1 August 2022, according to court proceedings. Pseudomonas aeruginosa is a bacterium that thrives in damp environments such as taps and shower fixtures. Chris Elliot was allocated the contaminated room upon his admission on 9 August 2022. Water quality monitoring at the hospital was assigned to Gloucestershire Managed Services, a subsidiary owned by the trust. Lead prosecutor James Marsland said, "Reporting was required – it didn’t happen." Barrister Paul Greaney KC stated that the facility would have deactivated the shower if the contamination had been reported.
The trust’s water safety committee did not convene for nine months, violating a mandated quarterly meeting schedule. Chief executive officer Kevin McNamara said, "We are deeply sorry for the death of Dr Christopher Elliot and for the profound impact this has had on his family. This was a tragedy that should never have happened." District judge Nick Wattam noted that the trust demonstrated remorse and implemented corrective measures.
Victoria Elliot, widow of the deceased, stated that the £300,000 financial penalty was inadequate. "He was treated with a mixture of arrogance, incompetence and a cavalier attitude to his safety," Elliot said. "I question how an organisation whose raison d’être is meant to be to care for the patient and his/her relatives should use every opportunity to delay admitting liability." She said, "Chris had absolutely no chance of survival, showering every day in his isolation room in a lethal dose of bacteria. Chris’s death occurred in great part as a result of the abject failure of care by the very people tasked with looking after him."
